Terms and Conditions

These terms form the entire agreement between Kieran Vyas and the client, and override any alternative terms proposed by the client unless agreed in writing.

  1. Kieran Vyas retains full copyright over all photographic work in accordance with the Copyright, Designs and Patents Act 1988. He asserts the right to be credited as the author of the work using the phrase: ‘Photographs by Kieran Vyas’.
  2. Clients may enjoy an exclusive period to use the commissioned images. However, Kieran Vyas reserves the right to showcase the images for promotional or marketing purposes at any time, globally. After any agreed exclusivity period, images may be reused by Kieran Vyas for any reasonable purpose. Editorial content may be made available to third parties after its original publication unless otherwise stated.
  3. Unless otherwise stated in a specific licence, clients are granted a perpetual licence to use the images for marketing, PR, and editorial purposes.
  4. Copyright remains with Kieran Vyas in all cases, worldwide.
  5. All confidential information shared with Kieran Vyas as part of a commission will be treated with discretion and used only as necessary to fulfill the work agreed.
  6. All personal data is managed in line with UK Data Protection law. You can read more about your rights on the Information Commissioner’s Office (ICO) website.
  7. It is the client’s responsibility to ensure that all necessary permissions are in place for photography, including property permissions, trademark clearance, or parental/guardian consent when minors are involved. Kieran Vyas is not liable for the absence of such permissions or any resulting image restrictions.
  8. Payment is due within 30 days of invoice issue. Invoices not settled within this period may incur interest in line with the Late Payment of Commercial Debts (Interest) Act 1998.
  9. If additional work, time, or costs are required due to changes made to the original brief, the client agrees to cover these at Kieran Vyas’s standard rates.
  10. Commissioned images will be available to access and download for 6 months from the shoot date. Longer availability can be arranged on request.
  11. Unless a rejection fee has been pre-agreed, the client accepts that style and composition are at the photographer’s discretion and not grounds for rejection.
  12. Once a booking has been confirmed, cancellation fees may apply: 48 hours: 75%. 24 hours or less: 100%.
  13. This agreement is governed by the laws of England and Wales.
  14. Any amendments to these terms must be confirmed in writing and agreed by both parties.
